New York State Supreme Court Rules To Reinstate Employees That We’re Previously Fired For Being Unvaccinated; Must Issue Backpay!

Cousins! New York State Supreme Court has officially directed a new order after identifying that employees rights have been violated under the previously issued Covid-19 vaccination mandate!

According to Fox News, the Supreme Court has officially reinstated all employees who were previously fired for not being vaccinated. They state that each employee must receive full back pay ranging from the date they were let go to now.

Court documents read that on Monday it was confirmed that “being vaccinated does not prevent an individual from contracting or transmitting COVID-19.” This news comes just months after Mayor Adams claimed that he would not allow his administration to rehire any person that had been fired due to their vaccination status.

It has been indicated that since the mandate was issued over 1,400 people had been fired from their jobs. Many of those people previously held jobs as law enforcement or firefighters.

David Chokshi, the city’s health commissioner, issued an order in October 2021 requiring all city employees to be inoculated against the virus. Later, Chokshi issued a similar order for private-sector employees; Mayor Eric Adams signed a supplementary executive order to that latter mandate carving out exemptions for athletes, musicians, and other performers.

According to Yahoo News, the city has filed an appeal according to a spokesman for the law department, who said that “the city strongly disagrees with this ruling as the mandate is firmly grounded in law and is critical to New Yorkers’ public health.”

It has been stated that the courts identified both Chokshi’s and Adams’s orders as “arbitrary and capricious,” also stating that they both violated the New York State constitution.
